Refund Policy
Memberships are non-refundable due to the digital nature of our training. Intellectual property is considered accessible once registered. All memberships are a minimum 12-month commitment.

Cancellation Policy
Monthly Plan: Early cancellation incurs 50% of the remaining contract. After 12 months, the plan rolls month-to-month with 30 days' notice required.

Annual Plan: Non-refundable. Your membership auto-renews every 12 months unless written cancellation is received 21 days prior to the renewal date.

Intellectual Property
All content on the site is the property of Tom Panos Pty Ltd and is protected by copyright, trademark, and other laws. You may not use or distribute our content without written permission.

Termination

By opting into the WhatsApp Accountability Chatbot operated by Tom Panos Pty Ltd (“we”, “our”, “us”), you agree to the following Terms of Use.

1. Purpose of the Service

The WhatsApp Accountability Chatbot is an automated accountability and performance tracking tool designed for members of the Real Estate Gym community.

The service allows users to submit:

• Daily call connect numbers; and
• A self-selected energy status:
  • High
  • Ok
  • Low

The purpose of this feature is to support professional accountability, consistency, productivity, and business performance tracking.

This service is not a mental health service, medical service, counselling service, crisis support service, or healthcare product.

2. Eligibility

To use this feature, you must:

• Be at least 18 years of age; and
• Hold an active Real Estate Gym membership.

If your membership is cancelled, suspended, or expires, access to the chatbot feature may also be terminated.

3. Opt-in Consent

You may opt into the service by replying:

“I’m in”

By opting in, you consent to:

• Receiving automated WhatsApp messages;
• Submitting daily accountability information;
• The secure storage of your submitted data; and
• Communications relating to your Real Estate Gym membership and accountability tracking.

You may opt out at any time by replying: “Stop”

Once you opt out, you will no longer receive accountability prompts via WhatsApp.

5. Data Collection & Storage

The chatbot stores information submitted by users, including:

• Daily call connect numbers;
• Energy level selections; and
• Basic interaction and usage data.

Tom Panos Pty Ltd takes reasonable steps to securely store and protect this information.

Your data will only be used for:

• Accountability tracking;
• Performance insights;
• Coaching and training support;
• Service improvement; and
• Internal business operations related to Real Estate Gym.

We do not sell your personal information to third parties.

6. Not a Mental Health or Medical Service

The chatbot is intended solely as a business accountability tool.

The “energy level” responses are general self-assessments for productivity and accountability purposes only.

They are:

• Not monitored by healthcare professionals;
• Not intended to diagnose, treat, monitor, or assess mental health conditions; and
• Not a substitute for medical advice, counselling, psychological support, or crisis intervention services.

If you are experiencing mental health concerns, emotional distress, or a medical emergency, you should seek assistance from a qualified healthcare professional or emergency service immediately.

7. No Liability

To the maximum extent permitted by law, Tom Panos Pty Ltd is not liable for:

• Any decisions made based on the use of the chatbot;
• Any business, financial, emotional, or personal outcomes connected to the service;
• Any interruption, delay, or technical failure of the service; or
• Any loss or damage arising from reliance on the chatbot.

You use this service voluntarily and at your own risk.

• Suspend or discontinue the feature;

Continued use of the service after updates constitutes acceptance of the revised terms.
